Legal Services

The Legal Section for Chilanga Town Council was created in 2019 when the Council Advocate position was created. The department provides legal advice to the Council and ensures that the Council is operating in accordance with the laws of the republic of Zambia. Currently, under the Legal Department there is:

  • Licensing
  • Deeds and Estates registry
  • Litigation
  • Contracts
 

LICENSING

Licensing is the formal process of granting legal permission for individuals or businesses to operate within the Chilanga district. This includes issuing various types of licenses—such as trading, liquor, occupancy, and scheme licenses—based on compliance with local regulations and payment of required fees. Licensing is a key tool for town councils to manage growth, protect residents, and promote orderly development.

DEEDS AND ESTATES

Deeds and estates refers to managing land and property-related matters within the council’s jurisdiction. It plays a key role in ensuring legal ownership, orderly development, and proper documentation of land and buildings. The following services are provided at the council: –

  • Scheme licences ( Provisional titles 14 years ).
  • Occupancy ( 30 years) is meant for Unplanned Settlements .
  • Change of ownership ( only done on occupancy license and schemes.
  • Mortgages.
  • Deed of transfers.

LITIGATION

This is the legal process where the council is either defending itself in court or initiating legal action to protect its interests. Since Chilanga town council is a legal entity, it can sue and be sued under applicable laws. And where it is in the best interest of the Council, the Legal section settles matters out of court.

CONTRACTS

The Legal section is responsible for preparing all contracts for the Council.
